The Swatch Group attacks Samsung for forgery

Just a few days after the Galaxy Watch Active, its new smart clocks, Samsung has been subject to a Swatch complaint. The Biel Group accuses the South Korean giant of illegally making up to thirty digital numbers that mimic its own brands. In his opinion, the visual images of Gear Sport, Gear S3 Classic and Gear S3 Frontier are associated with "identical or almost identical signs" as with its models.

According to a complaint filed last Friday at a court in New York, a group of 18 stamps claims that "three-digit, in millions of dollars" compensation – at least 100 million. Appeal: "an obvious, deliberate and international violation of our trademarks" in order to "jeopardize the reputation and reputation" of Swatch's products and brands.

Illustrations in the complaint leave no doubt: the relevant calls that can be downloaded from the Samsung Galaxy Apps online store are facsimile numbers Breguet, Blancpain, Glashutte Original, Jaquet Droz, Omega, Longines, Tissot, Mido, Hamilton or Swatch, all owned by the group Swatch. Some models from limited editions are worth up to 650,000 francs. "Samsung has refused to share the total number of downloads. The brands concerned are worth billions," says the head of communications.

The complaint states that Swatch's lawyers in December contacted an Asian company for the same problem. The latter then removed the controversial call from the application, but dozens of others reappeared. "Given the inadequate response from Samsung, it makes sense to conclude that it will continue to violate the brand and cause additional losses and damage," said Swatch Group. If the similarities between the official models and those offered by Samsung are obvious, digital numbers are not offered only by a Korean group, but by a third party. The online store Samsung Galaxy Apps is open to all international developers who want to submit their creations. Samsung then confirms the selection and places it on the web application. When users upload an image, the Korean group gets a percentage of sales. Another giant attached clock, Apple, works differently: only own calls are available in their online store, which prevents such problems.

This is not the first time that the world leader of watchmaker attacks judges against his rivals. In recent years, Swatch has filed several lawsuits on websites distributing related watches whose dials were similar to their own. In 2016, the Swiss company even managed to ban the use of the iWatch iWatch trademark in the United Kingdom, an Apple-related watch that considered the name to be too similar to Swatch and ISWATCH, two trademarks registered in 1981 and 2007.
